Resolution approving, consenting to, and confirming the appointment by the Mayor of William Babcock (Alternate), as a member of the Architectural Review Commission, for the remainder of a three (3) year term commencing on November 6, 2025, and ending on February 1, 2026.
Background
On February 2, 2023, the City Council of the City of Tampa approved Resolution No. 2023- 144, approving, consenting to, and confirming the appointment by the Mayor of Robert Myles (alternate), as a member of the Architectural Review Commission for a three (3) year term, commencing on February 2, 2023, and ending on February 1, 2026 and Mr. Myles has missed three (3) consecutive regular meetings and should be replaced in accordance with section 27-112(g) of the City of Tampa Code of Ordinances.
The Mayor appoints and hereby submits to the City Council of the City of Tampa the name of William Babcock (alternate) as a member of the Architectural Review Commission for the remainder of Mr. Myles term, with Mr. Babcock’s term commencing on November 6, 2025, and ending on February 1, 2026.
Resolution approving the Renewal of the Billing Service and Business Associate Agreements between the City of Tampa and Advanced Data Processing, Inc., a subsidiary of Digitech Computer LLC, without a price escalation, for the provision of Emergency Medical Transport Billing Services in the estimated amount of $952,516.05 for use by Tampa Fire Rescue.
Background
The City’s Tampa Fire Rescue has a continual need for Billing and Collection Services for Emergency Medical Services (EMS). Fees are billed and collected for EMS provided to patients who are transported to a medical facility and cover the cost of transportation, oxygen, medications, intravenous set-ups, medical supplies, etc. used by Tampa Fire Rescue.
Tampa Fire Rescue in its best interest is requesting to renew its utilization of the City of Riviera Beach’s contract under Riviera Beach, Florida 36-20 because it is not cost effective or in the best interest of the City to solicit its own proposal. Riviera Beach, Fl renewed their current contract with Advanced Data Processing to provide the services. Additionally, the unit pricing is more favorable with the City of Riviera Beach, Florida’s contract.
Advanced Data Processing is experienced with Tampa Fire Rescue’s billing and collections processes and procedures, has maintained the City’s account for numerous years and has continued to provide excellent service. Advance Data Processing would like the opportunity to continue providing the same services for the City.
(Part 1of 2)(See Item 6) Resolution approving an Agreement between the City of Tampa and the Florida Commission on Community Service, otherwise known as Volunteer Florida (contract No. 2025-05), and accepting the 2025-2026 Community Emergency Response Team (CERT) Grant in the amount of $10,000.
Background
This Agreement authorizes payment from the Florida Commission on Community Service, DBA Volunteer Florida, in the amount of $10,000 over a period of one (1) year, for services in support of the Community Emergency Response Team (CERT) Grant related to the procurement of equipment and materials to support the CERT program, background checks, and training. This resolution approves a cost-reimbursement contract in the amount of $10,000 within the Fire Grants Fund for Tampa Fire Rescue from the Florida Commission on Community Service, DBA Volunteer Florida. This is a federal pass-through grant. The City is committed to a match requirement of $10,000, for a total budget of $20,000. The City’s match requirement will be fulfilled by volunteer hours for training and exercise events, valued at $33/hour.

Background
The City of Tampa desires to enter into an Agreement with GTE, who is the owner of land and improvements commonly known as the GTE Financial Headquarters located at 711 E.
Henderson Avenue, Tampa, FL 33602 known as Property. The City desires to utilize approximately 200 square feet of rooftop space on the main building located at the Property for installation and operation in support of it’s DFR Program. This location will enable quicker response times to our densely populated entertainment areas and special events. Such uses permitted by GTE shall be at no cost to the City of Tampa and are subject to the terms and conditions of the attached Agreement. It is in the best interest of the City of Tampa to enter into the Agreement.

The Tampa Police Department and Tampa Fire Rescue were awarded the Fiscal Year 2025 Port Security Grant Program in the amount of $265,727. As a condition of this award, the City is required to provide a $88,576 non-federal cost match, bringing the total approved project costs to $354,303.
The Tampa Police Department’s project is fully funded at $178,291, which includes a $44,573 City match. The Tampa Fire Rescue’s project is fully funded at $176,012, which also includes a $44,003 City match.

Background
The Tampa Convention Center has standardized to Trane U.S. Inc. for the purchase of All Labor, Materials and Equipment for One (1) AHU 15 Chilled Water Handling Unit.
Standardization to this equipment/service ensures cost reduction, interoperability because of familiarity amount staff, maintenance efficiency and reduced cost of inventory maintenance for parts; uninterrupted delivery of service, reduction of redundancy and costly expenditures for implementation of a new service. It is recommended that the City purchase Air Handlers, Fan Coils and other HVAC Equipment and Services from Trane U.S. Inc.

(Part 1of2)(See Item 14) Resolution approving a settlement agreement and release of claims between the City of Tampa, Florida and Atlantic Specialty Insurance Company, where ASIC agrees to pay a settlement sum in the amount of $766,409.29 to the City of Tampa, in connection with Contract 21-C-00024, the Palma Ceia Water Main Replacement Phase III.
Background
In 2021, the City awarded 21-C-00024 Palma Ceia Phase III Water Mains Improvement contract to Young’s Communication, LLC (“YCOMM”). The original construction timeline was for 527 days. After much hardship and delays, in March 2025, more than 1,200 days into the construction, YCOMM filed for bankruptcy and defaulted.
The City made a claim on July 24, 2025, with the surety bond company Atlantic Specialty Insurance Company to cover the cost for the remaining work. Due to the surety’s delayed responsiveness in acquiring a replacement contractor, as well as the unsafe and emergency site conditions left by the defaulted contractor (YCOMM), the City procured our own contractor to quickly and competently complete the work. As a result, the City and Atlantic Specialty Insurance Company negotiated a settlement agreement in the amount of $766,409.29 to partially cover the cost for Kiewit to complete the remaining scope of the water main capital improvement project.

Background
The Wastewater Department has standardized Flygt replacement parts, products, pumps and repair services from Xylem Water Solutions USA Inc. Standardization to this service and equipment ensures cost reduction, interoperability because of familiarity among staff, maintenance efficiency and reduced cost of inventory maintenance for parts and also uninterrupted delivery of service, reduction of redundancy and costly expenditures for implementation of a new service. Resolution accepting the proposal of Inliner Solutions, LLC Pertaining to Contract 25-C-00007 Wastewater Tuberculated Gravity Pipeline Rehabilitation by Cured-In-Place Pipe Lining, in the amount of $1,998,650; authorizing the Mayor of the City of Tampa to execute said contract on behalf of the City of Tampa.

- Business Case: This project provides for the rehabilitation of 8-inch, 10-inch, 12-inch, 15- inch, 18-inch, and 24-inch diameter gravity sewers at various locations throughout the City of Tampa Wastewater Department’s service area including detuberculation, cleaning and inspection, sewage bypass pumping, maintenance of traffic and surface restoration.
- Equal Business Opportunity (EBO) Statement: The bidder did not utilize any certified firms; however, Inliner Solutions provided sufficient documentation to be found compliant with the GFE process. The Cured-In-Place Pipe (CIPP) work is a highly specialized scope.
- Sustainability and Resiliency: This project provides for the rehabilitation of failing gravity sewers by using no-dig methods. The rehabilitation method requires no excavation and will extend the useful life of the sanitary sewer pipeline beyond 50 years. Since no excavation is required, pipeline repairs can be performed quickly, minimizing impacts to traffic, and the need to make costly roadway repairs.

Background
The Pinellas Suncoast Transit Authority (“PSTA”) was established in 1984 as the public transit district for various municipalities within Pinellas County and provides bus and trolley services within Pinellas County; and PSTA recently received Federal Ferry Vessel Grant Nos.
D2022-PFGP-004 and D2022-PFGP-005 totaling $4,863,280 to PSTA to purchase a vessel for ferry services and PSTA is responsible for overseeing the procurement of a private operator who will assist PSTA in acquiring vessels and operating a ferry service; and the ferry will provide year-round service connecting downtown waterfront Tampa to downtown waterfront St. Petersburg; and the City of Tampa (“City”) recognizes the ferry will provide an efficient and reliable waterborne transit connection to and between major cities and destinations around Tampa Bay and avoid bridge traffic and parking expenses, while also highlighting the regional identity of a major urban coastal area; and the ferry is expected to be highly utilized by residents of Pinellas and Hillsborough counties and this benefits both residents and visitors in easing mobility between the cities of St. Petersburg and Tampa; and the City desires to support the operation of the ferry by making a financial contribution in an amount not to exceed $350,000; and the purpose of this Tampa Bay Ferry Interlocal Agreement is to provide for the City’s support. Background
By authority contained in Resolution No 2023-276, passed and adopted by City Council on March 16, 2023, the City of Tampa entered into agreements with Incapsulate, LLC for the Software and Implementation Services for a Customer Relationship Management (CRM) Solution. Pursuant to authority contained in Resolution 2025-311, passed and adopted on April 03, 2025, the City executed an Assignment Agreement with Incapsulate, LLC and Accenture LLP assigning the agreements to Accenture LLP. It is necessary to amend the Managed Services Statement of Work (SOW) to amend the Scope of Services to include Managed Services maintenance and support.
Resolution making certain changes in the budget of the City of Tampa for the fiscal year ending September 30, 2025; approving the transfer, reallocation, and/or appropriation of $284,411 within the Downtown/Ybor Tourism Marketing District Fund to provide tourism marketing services within the district.
Background
Ordinance No. 2017-42, amended by Ordinance 2020-54, created the Downtown/Historic Ybor Tourism Marketing District (TMD) and established a process for levying and collecting a tourism marketing non-ad valorem special assessment.
Resolution 2021-106 was approved by City Council on February 4, 2021 to delegate the power and authority to manage and administer the affairs of the District to the Hillsborough County Hotel and Motel Association, Inc., for a twenty-year term.
The non-ad valorem special assessment provides for tourism marketing services within the TMD aiming to attract overnight visitors and reach additional market segments needed to ensure the City and the District remain a competitive tourism market.
The non-ad valorem special assessment is paid by specific tourism properties located within the TMD that are receiving a benefit from this assessment and are included in the tourism marketing non-ad valorem assessment roll. The assessment is based on a fixed rate charged to the total number of hotel rooms. The assessment is collected by the Hillsborough County Tax Collector’s Office and submitted to the City, net of administrative costs (1%). The City of Tampa submits the revenue received from the Tax Collector’s Office to the Hillsborough County Hotel and Motel Association on a monthly basis, net of administrative costs (1%).
FY2025 Hotel Voluntary Contributions: This Resolution appropriates additional FY2025 revenue in the amount of $284,411 collected by the Hillsborough Tax Collector’s Office and provided by certain participating hotels included within the non-ad valorem assessment roll for an amount that exceeded their FY2025 assessment. Based on the information provided by the Hotel & Motel Association, the TMD has consciously approved the commitment to installment payments in connection with the recruitment of convention groups in FY2024 – FY2026, called the TMD Convention Concession Fund. As a result, many of the participating hotels have decided to pay more than their assessment, with the understanding that the surplus will allow the TMD to maintain its digital marketing campaign commitment, which allows for generating supplemental room revenue with leisure-based business while growing its convention group recruitment and retention program.
Pursuant to Section 166.241(8)(a), under certain circumstances a local government within 60 days following the end of the fiscal year may amend a budget for that year.
Resolution of the City of Tampa, Florida, approving a Statement of Work Incident Response Retainer between the City of Tampa and Optiv Security Inc. for the provision of Incident Response Retainer Service in the estimated amount of $49,556 over a one-year term for use by the Technology and Innovation Department.
Background
It is recommended that the City enter into an agreement with Optiv Security Inc. for Incident Response Retainer Service for use by the Technology and Innovations Department. The term of the agreement is effective upon execution of the agreement and will automatically renew until terminated according to the agreement terms.
SLBE participation goals were not prescribed because the project did not meet required EBO parameters.

Background
The Financial Accounting Foundation is a not-for-profit organization that oversees the Financial Accounting Standards Board (FASB) and the Government Accounting Standards Board (GASB). These boards are responsible for setting high-quality financial reporting standards within the United States, known as Generally Accepted Accounting Principles (GAAP).
Recently, GASB implemented GASB Pronouncement 96 which addresses how governments treat agreements for subscription-based information technology services (SBITA). Prior to GASB 96 these subscriptions were treated as an annual operating expense. Now the standard requires them to be reported as a long-term asset and liability on the balance sheet.
This allows the balance sheet to reflect the City’s long-term liability associated with long-term subscriptions.
The City’s Accounting Office reviews all approved contracts to determine the correct treatment on the City’s balance sheet. If they identify a contract would fall under the purview of GASB 96, they notify the Budget Office that a required financial resolution is needed in the fiscal year the contract approved by Council.
GASB 34 required that items be placed on the balance sheet must flow the budget, thereby requiring financial resolutions. The financial resolution appropriates the full value the subscription as both a revenue and capital operating expenditure. Therefore, the attached financial resolution, with a value of $30.6 million, has no net effect on the budget as both the revenues and expenditures are the same amount.
In subsequent fiscal years, the use of the scription service is expensed as a debt expense instead of an operating expense as would have been the expense prior to GASB 96.

This resolution reflects appropriation changes totaling $8,151,291 as part of 2025 non- carryforward fiscal year-end closing process. A.General Fund Final Year-End Personnel and Operating Budget Adjustments.
Appropriates an additional $2.5 million of revenues to adjust various departments’ personnel and operating budgets. Additional revenues of $1.9 million in state assistance for the Fire and Police Pensions, $0.3 million for fire additional extra duty, and $0.3 million in Convention Center revenues. These budget adjustments were previously identified as being needed in the departmental monthly reports.
B.Closing the American Recovery Plan Act Program Local Option Gas-Tax Fund. Increases the General Fund’s contribution to the Local Option Gas Tax for operations and maintenance of the City’s transportation infrastructure. Hurricane Local Match Funding for FEMA-designated events generally has the following shared funding requirements: Federal Government75.0% State 12.5% Local12.5% However, these cost-sharing guidelines for debris removal and local government expenses related to preparing and responding to the storms were waived by President Biden for Hurricanes Helene and Milton. Since last fall, the City has encumbered and/or expended funds for non-general fund departments (Solid Waste, Water, and Wastewater). This financial resolution appropriates and transfers the local match (12.5%) from these three departments for actual expenditures and encumbrances into the FEMA recovery fund.

City and Kimmins Contracting Corp. (Kimmins) entered into that certain License and Hold Harmless Agreement dated February 22, 2023 (License Agreement), approved by Resolution2023-163, for use of a portion of City Property, consisting of approximately 11 acres, as an office compound and material laydown yard in connection with the City of Tampa Contract 19- C-00059 Lower Peninsula Stormwater Improvement Project – Southwest Region – Design Build for which Kimmins is the firm providing professional design build services.
Kimmins is also the firm providing professional design build services for City of Tampa Contract 23-C-00021 South Howard Flood Relief & Streetscape Project Design Build. Both projects require the continued use of the laydown yard in the area provided for in the License Agreement; therefore, the parties desire to enter into a First Amendment to License and Hold Harmless Agreement to extend the term of the agreement by providing two additional renewal options for one year each.
The City’s Solid Waste Department reviewed and approved this request. No rent will be charged for this request since Kimmins is performing work under City contracts.

The Foreign Trade Zone No. 79, located in the Tampa Bay region, supports companies in Tampa Bay and along the I-4 Cooridor in streamlining the process and reducing costs associated with eligible importing, exporting, manufacturing and distribution activities.
The City of Tampa, as Grantee of Foreign-Trade Zone No. 79, has been authorized by Sections 288.35-288.38 of the Florida Statutes, to apply for and accept a Grant of Authority from the United States Foreign-Trade Zones Board to establish, operate, and maintain a foreign-trade zone and subzones with the State of Florida. Foreign-Trade Zone No. 79 Board Inc., manages Foreign-Trade Zone 79 and its subzones for the City of Tampa. The Department is seeking approval to expand Foreign Trade Zone 79 by creating a new subzone, 79I that expands commercial and employment opportunities.
Staff respectfully requests approval of this agreement, between the City of Tampa, Florida (Grantee), Foreign-Trade Zone No.79 Board Inc. (Board), and CSX Transportation, Inc.

Resolution approving the renewal of an Award between the City of Tampa and Merion Landscape Services LLC, without a price increase, for the furnishing of Ditch Mowing and Maintenance Services for Central and South Zones in the estimated amount of $640,000 for use by the Mobility Department.
Background
It is recommended that the City renew its existing award with Merion Landscape Services LLC for the provision of Ditch Mowing and Maintenance Services for Central and South Zones for use by the Mobility Department for an additional one-year term. The existing award was made in November 2024. This award is in its original award term.
Merion Landscape Services LLC provides satisfactory service, quality of product and performance. The Mobility Department has reviewed the prices and feels that it is in the best interest of the City to renew the award for an additional one-year period. Merion Landscape Services LLC has agreed to renew Ditch Mowing and Maintenance Services for Central and South Zones without a price increase which is allowed per the bid.

Notwithstanding staff’s finding of inconsistency, if City Council approves the application, the modifications to the site plan as shown on the submitted revision sheet must be completed between first and second reading. These revisions will not resolve the issues of Transportation’s inconsistent finding.

Background
The City of Tampa is proposing to designate an area in West Tampa of approximately 1.08 acres for brownfield designation. The details of the is proposed brownfield area designation have been reviewed by staff of the Planning and Development Department, Legal Department, and the Department of Solid Waste and Environmental Program Management.
This proposed designation meets all requirements that are specified in Florida Statues, known as the ” Brownfields Redevelopment Act”. In an effort to encourage and facilitate cleanup and redevelopment in West Tampa, City Staff recommends the designation of the area identified as Cypress Housing project as a brownfield. Details of the proposed brownfield area are outlined in the attached Staff Report on Cypress Housing Project September 2025.

3.Business Case: •This project provides for furnishing all labor, materials and equipment for the construction of approximately 25,800 lineal feet of 4-inch through 12-inch diameter PVC Pipe (by open cut excavation) and / or HDPE Pipe (by directional bore), including asphalt pavement, concrete driveways, concrete sidewalks, sodding restoration, maintenance of traffic, and surface restoration as necessary.

5.Sustainability and Resiliency: Replacement and rehabilitation of the infrastructure will restore the structural integrity and eliminate leaks into the wastewater collection system that can lead to wastewater overflows during wet weather events. The reduction of leaks also reduces the energy needed to convey and treat the additional water that enter the mains and manholes. The replacement and rehabilitation will extend the useful life of the infrastructure for approximately 50 more years.

Prior to approving the transfer of $334,748.48 from the South Tampa and Central Tampa Tree Trust Fund, Council is to see the data required to create the annual report referenced in Chapter 27, Section 16-86(f) Reporting. Which states, a tracking and report system for each of the five (5) trust funds shall be established to track each payment made into the fund and each mitigation tree planted. Annually a report shall be prepared, for each fund, and forwarded to City Council with the following information: 1) Each payment made into the fund along with the identifying information of the source of such funds, such as a corresponding building permit number; 2) Each expenditure from the fund, including the types of numbers of trees; 3) The coordinates or other physical location information of mitigation trees planted by the city with funds expended from the tree trust fund; and 4) The status of the health of each mitigation tree planted at the six (6) month and one (1) year mark after planting. By “types” of trees, the ordinance is referring to type 1,2,3 or palm as stated in Table 284.3.2-A, which is the City Tree Matrix. Further, the Builders and T-TAG agree, they want to see the data collected for the 5 separate planning districts (Central Tampa, Westshore, University, New Tampa, and South Tampa) before any change to the current Tree Trust Fund Ordinance or expend any money from the fund; further, staff to provide a report on the Tree Canopy Study.
