    Resolution accepting the Instrument of Donation of a bike trailer, estimated value $9,604.50, from RISE Tampa Our Police Foundation for use by the Tampa Police Department.

    Background

    RISE Tampa Our Police Foundation has offered to donate to Tampa Police Department’s Bike Unit, a 7 ft x 16 ft 7K (3500 lb. axles) utility with 50 – amp Electric AC bike trailer, valued at nine thousand six hundred and four dollars and fifty cents ($9,604.50). Acceptance of such donation would benefit the City of Tampa Police Department Bike Unit.

    Resolution approving a Professional Behavioral Health and Wellness Agreement between the City of Tampa (The City) on behalf of Tampa Police Department and C3: Connect, Communicate, Collaborate, LLC (C3) for an initial amount of $135,000.

    Background

    The City of Tampa received a grant from the Department of Justice Law Enforcement Mental Health and Wellness Act and entered into a subgrant agreement with C3 to provide mental health services which includes individual counseling, critical incident debriefing and mental health wellness educational presentations, courses and other related services to benefit the law enforcement officers of the City of Tampa. The grant ended and the City wishes to continue working with C3 to continue to provide these valuable services for future fiscal years subject to annual appropriation. Entering into the agreement with C3 will benefit the citizens of the City of Tampa.

    Resolution approving an Addendum to Order Form ID Q-08811538 between the City of Tampa and West Publishing Corporation dba West, a Thomson Reuters Business for the standardization purchase of Thomson Reuters – CLEAR in the estimated amount of $52,848.36 for use by the Tampa Police Department.

    Background

    The Tampa Police Department has standardized to Thomson Reuters – CLEAR from West Publishing Corporation dba West, a Thomson Reuters Business. Standardization to this service ensures uninterrupted delivery of service, reduction of redundancy and costly expenditures for implementation of a new service. It is recommended that the city purchase Thomson Reuters – CLEAR.

    There was no EBO Participation as this purchase is being made under a standardization.

    Resolution approving a copyright license and indemnity agreement between the City of Tampa, Florida and University of South Florida Board of Trustees to allow use of certain City copyright protected photographic images for promotion of the Gasparilla Distance Classic Kid’s Run at no cost to the City.

    Background

    The University of South Florida Board of Trustees (Licensee) desires to use images owned and retained by the City of Tampa (Licensor) for promotional purposes. Licensor has received written consent to use individual images taken during Licensor events, activities, and programs. The Licensor through its Parks & Recreation Department will coordinate with Licensee for use of Licensor owned images for the limited purpose of promoting the Gasparilla Distance Classic Kid’s Run. City Council does hereby affirm that it would be beneficial to the residents of the City to enter into this Copyright License and Indemnity Agreement between the City of Tampa and University of South Florida Board of Trustees.

    Resolution approving Amendment No. 3 to Standard Grant Agreement NO. CZ620 between the City of Tampa and the Florida Department of Environmental Protection.

    Background

    The grant agreement is for the Ben T. Davis Beach ADA Beach Improvements. The amendment updates the Match Table (Attachment 3C, page 5 of 6) in the agreement to reflect the actual project match to allow for the City to request reimbursement for this project.

    The Match Table is being amended to reflect that actual City staff who worked on the grant.

    FDEP has also updated the grant’s attachments which has no impact on the City’s ability to receive reimbursement.

    The funding amount of $60,000 and match amount of $60,114 is unchanged from the original agreement.     Resolution approving a license and hold harmless agreement between the City of Tampa and School Board of Hillsborough County to provide a license to the City through its Parks & Recreation Department to enter onto School Board property for the purpose of reestablishing use of an irrigation well at Blake High School to benefit the City West Riverwalk project at no cost to the City.

    Background

    The City of Tampa (“City”) and School Board of Hillsborough County (“School Board”) entered into a General Cooperative Agreement (“GCA”) to share use of their respective properties for recreation use.

    Pursuant to Article II, paragraph 7 of the GCA, either party is authorized to install irrigation at its own expense on the property of the other party.

    The City desires to reestablish use of the irrigation well at Blake High School to benefit the City’s West Riverwalk project.

    The parties have visited the site requiring improvements and determined a proposed work schedule to be implemented upon approval of this License and Hold Harmless Agreement.

    The School Board is willing to provide a license on the subject property to the City under the terms and conditions provided for in the License and Hold Harmless Agreement.

    City Council does hereby affirm that it would be beneficial to the residents of the City to enter into this License and Hold Harmless Agreement between the City and the School Board.

    Resolution of the City of Tampa, Florida accepting a gift of two (2) fifteen seat passenger vans at an estimated value of one hundred seventeen thousand six hundred and fifteen dollars ($117,615.00) from Children’s Athletic Network and Dance Opportunities, Inc. to be used for the Aquatics and Athletics Divisions within the Parks & Recreation Department to promote youth sports development and aquatic safety; authorizing the Mayor of the City of Tampa to execute the acceptance of said donation.

    Background

    The City of Tampa (hereinafter referred to as “City”) desires to accept a gift of two (2) Fifteen Seat Passenger Vans at an estimated value of One Hundred Seventeen Thousand Six Hundred and Fifteen Dollars ($117,615) from Children’s Athletic Network and Dance Opportunities, Inc. (hereinafter referred to as “Donor”) to be used for the Aquatics and Athletics Divisions within the Parks & Recreation Department to promote youth sports development and aquatic safety / drowning prevention. Acceptance of the donation is being undertaken in a manner consistent with the City Acceptance of Gifts & Donation Policy.

    Donor has agreed to execute the Instrument of Donation confirming its intention to donate two (2) Fifteen Seat Passenger Vans at an estimated value of One Hundred Seventeen Thousand Six Hundred and Fifteen Dollars ($117,615) (a copy of which is attached hereto as Exhibit A).

    City Council does hereby affirm that it would be beneficial to the residents of the City to approve acceptance of the donation.

    Resolution approving the execution by the Mayor and attestation by the City Clerk of a Fourth Amendment to License Agreement between the City of Tampa and Cellco Partnership, a Delaware general partnership, d/b/a Verizon Wireless, for the modification of telecommunications equipment on City property at the Tampa Convention Center located at 333 S. Franklin Street, Tampa, Florida.

    Background

    The City of Tampa (“City”) and Verizon Wireless Personal Communications, LP d/b/a Verizon Wireless, predecessor-in-interest to Cellco Partnership d/b/a Verizon Wireless (“Licensee”), entered into that certain License Agreement dated May 23, 2012, approved by Resolution2012-471, as amended (collectively, the “License Agreement”), for the installation and operation of telecommunications equipment on City-owned property known as the Tampa Convention Center, located at 333 S. Franklin Street, Tampa, Florida (the “Property”).

    City and Licensee desire to enter into this Fourth Amendment to License Agreement (this “Amendment”) in order to modify and amend certain provisions of the License Agreement.

    Rent will not be adjusted since the Licensee is not making any additions to their telecommunications facility. Licensee is replacing three outdated and non-functioning antennas.

    It is in the best interest of the City to enter into this Amendment under the terms and conditions stated therein.

    Resolution approving the execution by the Mayor and attestation by the City Clerk of a Restrictive Covenant by the City of Tampa, as owner, in favor of the State of Florida Fish and Wildlife Conservation Commission in connection with a grant to the Lowry Park Zoological Society of Tampa, Inc., to fund renovations on the property located at 1101 West Sligh Avenue, Tampa, Florida.

    Background

    The City of Tampa is the owner of the real property at 1101 West Sligh Avenue. Lowry Park Zoological Society of Tampa is under a long-term lease with the City of Tampa for the operation of ZooTampa. The City of Tampa, on behalf of ZooTampa, desire to enter into an agreement with the State of Florida Fish and Wildlife Conservation Commission in order for the Lowry Park Zoological Society of Tampa to obtain grant funds to construct and/or renovate the Manatee Rescue Complex, adding a new exhibit named “Reptile and Amphibian Discovery”.

    Resolution approving the purchase under Florida Sheriff’s Association Contract No. FSA25-VEH23.0 of Three (3) Battle Motors Raider w/ New Way Sidewinder Automated Side Loaders from Container Systems & Equipment Co., Inc. in the total amount of $1,367,205 for use by the Department of Solid Waste & Environmental Program Management.

    Background

    It is recommended that the City purchase under the Florida Sheriff’s Association Contract No. FSA25-VEH23.0 Heavy Trucks and Buses. This cooperative contract was competitively sourced with (34) thirty-four bids received by the leading agency. In comparing prices from the Florida Sheriff’s Association Contract No. FSA25-VEH23.0 Heavy Trucks and Buses, for the Battle Motors Raider w/New Way Sidewinder Automated Side Loaders the City’s cost is $455,735 per vehicle. The open market cost is $490,160 each vehicle for a total cost of $1,470,480 for three. The City saves $34,425 per vehicle for a total saving of $103,275 by purchasing the Battle Motors Raider w/New Way Sidewinder Automated Side Loaders from the Florida Sheriff’s Association Contract No. FSA25-VEH23.0 Heavy Trucks and Buses contract.

    Background

    It is recommended that the City purchase under the Florida Sheriff’s Association Contract No. FSA25-VEH23.0, Heavy Trucks and Buses contract. This cooperative contract was competitively sourced with (34) thirty-four received by the leading agency. In comparing the prices from the FSA25-VEH23.0 Heavy Trucks and Buses contract for the Battle Motors Raider Chassis with Labrie Automated Side Loader Body Vehicles, the City’s cost is $439,707.00 per vehicle. The open market cost of this vehicle is $471,748 each with a total cost of $943,496 for 2 vehicles. The City saves $32,041 per vehicle for a total saving of $64,082 by purchasing from FSA25-VEH23.0.

    Background

    It is recommended that the City purchase under the Florida Sheriff’s Association Contract No. FSA25-VEH23.0, Heavy Trucks and Buses contract. This cooperative contract was competitively sourced with (34) thirty-four received by the leading agency. In comparing the prices from the FSA25-VEH23.0 Heavy Trucks and Buses contract for the Battle Motors Raider CNG Chassis with Labrie Automated Side Loader Body Vehicles, the City’s cost is $527,155.00 per vehicle. The open market cost of this vehicle is $569,779 each with a total cost of $1,139,558 for two. The City saves $42,624 per vehicle for a total saving of $85,248 by purchasing from FSA25-VEH23.0.

    Resolution of the City of Tampa, Florida, approving a Use and Occupancy Agreement between the City of Tampa and the Florida Department of Transportation for the use of certain airspace below the I-275 Downtown Tampa Interchange by the Mobility Department.

    Background

    The Florida Department of Transportation (“Department”) holds sufficient legal right, title, and interest in the right-of-way of the I-275 Downtown Tampa Interchange in Tampa, Florida, including the airspace beneath the interchange (the “Airspace”), which forms part of a highway on the Federal Aid System; and Under Access Connection Permit No. 2025-A-796- 00010 issued by the Department, the City of Tampa has required that East Henderson Avenue be extended under the I-275 Downtown Tampa Interchange by a third party; and The Department wishes to permit the City of Tampa to use and occupy the Airspace more fully and three-dimensionally for the sole purpose of constructing, operating, and maintaining the East Henderson Avenue Extension; and The proposed use of the Airspace will not impair the full use or safety of the Downtown Tampa Interchange, will not allow vehicular access directly from the established gradeline of the interchange, and will not interfere with the free flow of traffic; and It is in the best interest of the City of Tampa to approve and authorize the Use & Occupancy Agreement with the Department for the use and occupancy of the Airspace to facilitate the extension of East Henderson Avenue.

    4. Equal Business Opportunity (EBO) Statement: Pursuant to the Equal Business Opportunity (EBO) Division review, HST Utility, Inc. has fully complied with the Good Faith Effort requirements and will self-perform the contract in its entirety.
    5. Sustainability and Resiliency: Tampa is a major City on the west coast of Florida, abutting the Gulf of Mexico. The geographic potable water service area of the Tampa Water Department extends beyond the City limits and represents an area approximately 220 square miles in size. The service area extends from Rock Creek to the west, Pasco County to the north, the Hillsborough River to the east, and Tampa Bay to the south. Small meters (<3”) are typically placed in the right-of-way adjoining private property, though some are located behind fences and inside buildings; residential meters are, mostly, located in meter boxes.

    • The Trimble project management software system will be utilized to optimize the monitoring of schedules and costs. This software was recently purchased by the City of Tampa and is a premier system for construction project management.

The term of the award is for a (3) three-year term with (1) one additional (2) two-year renewal option. The Department has reviewed and approved the bid response from Miner, Ltd. and comments were supplied via Department recommendation letter.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, it was determined that the EBO Bid Discount provision would apply in the bid specifications to eligible City of Tampa Certified firms.

    It is recommended that the City award McKay Bay Waste to Energy (WTE) Facility Vacuum Truck Services to Gaffin Industrial Services, Inc. for use by Department of Solid Waste and Environmental Program Management. The term of the award is for a (3) three-year) term with (1) one additional (2) two-year) renewal option. The Department has reviewed and approved the bid response from Gaffin Industrial Services, Inc. and comments were supplied via Department recommendation letter.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, it was determined that SLBE participation goals were not prescribed in the solicitation because 2 or more firms were not ready, willing, and able.

    Resolution of the City of Tampa, Florida, approving terms and conditions between the City of Tampa and Insource Software Solutions, Inc., for the furnishing of Aveva Flex in the estimated amount of $261,431.40 over a thirty-six month term for use by the Water Department.

    Background

    It is recommended that the City enter into an agreement with Insource Software Solutions, Inc. for Aveva Flex for use by the Water Department, Production Division. The term of the agreement is for a (3) three-year term. The Aveva Flex subscription is required to utilize the Flex Flip to System Platform as part of its new SCADA monitoring system as part of the SCADA Master Plan for use by the Water Department. This system is critical for the monitoring of equipment at the plant.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, it was determined that SLBE participation goals were not prescribed in the solicitation because the scope did not meet the required EBO parameters.

    Resolution approving an Assignment, Assumption, and Amendment Agreement between the City of Tampa, CB Anchor Machine & Fabricating, LLC, and Redfish Fabrication LLC dba Anchor Machine & Fabricating.

    Background

    It is recommended that the City renew its existing award with Redfish Fabrication, LLC dba Anchor Machine & Fabrication for the provision of Solid Waste – McKay Bay Waste To Energy (WTE) Facility Machine Shop Services for use by the Department of Solid Waste and Environmental Program Management for an additional one-year term. The existing award was made in June 2023. This award is in its original award term.

    Redfish Fabrication, LLC dba Anchor Machine & Fabrication provides excellent service, quality of product and performance. The Department of Solid Waste and Environmental Program Management has reviewed the prices and feels that it is in the best interest of the City to renew the award for an additional one-year period. Redfish Fabrication, LLC dba Anchor Machine & Fabrication has agreed to renew Solid Waste – McKay Bay Waste To Energy (WTE) Facility Machine Shop Services without a price escalation which is allowed per the bid.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, this one year renewal contract is in compliance.

    Resolution approving the execution by the Mayor and the attestation by the City Clerk of a License and Hold Harmless Agreement between the City of Tampa and the Tampa Port Authority d/b/a Port of Tampa Bay, Licensor(s), and Ye Mystic Krewe of Gasparilla, as licensee, in order to allow YMKG to construct a temporary retrofit of the hurricane-damaged Ballast Point Pier for their use at certain identified events.

    Background

    The City owns real property generally known as Ballast Point Park, which includes a fishing pier that has historically been used by members of Ye Mystic Krewe of Gasparilla (“YMKG”) to board their boats on the morning of the annual boat invasion and parade known as the Gasparilla Pirate Fest, and to disembark from their boats on the evening of the annual Gasparilla Outward Bound Voyage. Ballast Point Park and its facilities, including the Pier, suffered significant damage as a result of Hurricanes Helene and Milton in September and October, 2024, rendering the pier to be unsafe and inaccessible for use by the public in its current state. YMKG, with City and PTB approval, has consulted with an engineer and contractors who have evaluated the Pier and the feasibility of safely using it for limited purposes on a temporary basis by replacing certain missing planks, using temporary pre- engineered aluminum gangways with attached aluminum railings.

    Resolution approving a Funding Agreement (non-grant housing program funds) between the City of Tampa and Catholic Charities, Diocese of St. Petersburg, Inc.; providing funding up to $1,000,000.00 for the provision of services in support of homeless persons.

    Background

    Catholic Charities Diocese of St. Petersburg, Inc. has partnered with the City to provide support services to individuals and families experiencing homelessness. This agreement will provide for an amount not to exceed $1,000,000 in Housing Program Funds from the City to the Subrecipient to support the Tampa Hope Shelter in its serving of individuals experiencing homelessness.

    Staff is requesting City Council’s consideration and approval of the attached Agreement and Resolution to allow for the execution of the Agreement that will allow for Catholic Charities Diocese of St. Petersburg, Inc. to continue providing support services to individuals and families experiencing homelessness. Housing and Community Development will monitor the services to ensure eligible individuals and families are being served

    Bryan Bean (Owner 2906 N. Shoreview Place) obtained a Minor Work Permit No. 81018 from the Environmental Protection Commission for construction of certain dock structures and facilities, including a dock with a non-covered boatlift, on the Hillsborough River. Owner enjoys certain riparian rights, as the upland owner to the waters of the Hillsborough River.

    The owner has agreed to enter into a private dock agreement with the City for use of the City’s submerged lands to construct, use and maintain a dock.

The area is currently served by a gravity conveyance system that is old and undersized, and during storm events the park and surrounding neighborhood streets experience severe flooding. The Project will construct approximately 6,000 linear feet of new box culverts that will serve the adjacent commercial business area where there is currently no existing drainage system. The Project will also construct a new drainage conveyance system to reduce flooding in approximately 259 acres of a highly urbanized basin that will reduce the existing flooding problem up to the 100-year storm event.

    It is recommended that the City approve a buy-add for additional funding for the Suspension System Repairs Award due to increases in time-consuming and labor-intensive suspension repair work.     Amendment 1 provided funding for the additional scope discovered during the initial design development stage. As design was being developed it was determined that due to the condition of the systems and equipment at the Waste to Energy Facility, the scope required was much greater than initially anticipated.

    Guaranteed Maximum Price (GMP 1) provided for the design, development of construction documents, equipment purchases for long lead time items, and pre-construction services necessary to develop a GMP2 for the construction of the Solid Waste Department McKay Bay Waste-To-Energy (WTE) Facility Upgrades.

    Guaranteed Maximum Price (GMP 2) provided funding to make progress payments on equipment ordered through GMP1 as final design and construction documents were being completed.

    Guaranteed Maximum Price (GMP 3) provided for final payments on equipment purchases as well as the costs of construction to complete the work. GMP 3 was a change order to the GMP 1 and GMP 2 agreements. The purpose of GMP 2 was to supply funding to make progress payments on equipment ordered through GMP 1 as final design and construction documents were being completed.

    This Change Order 1 Final provides for the deduction for the city assumption of the balance of the Purchase Order Authorization to Merrick Industries Inc. for equipment ordered but not yet delivered and for the return of unused portion of the Owner’s Contingency.
