    Resolution approving a License and Hold Harmless Agreement between the City of Tampa, Florida, and Suffolk Construction Company, Inc. a for profit organization to allow the installation and teardown of scaffolding and temporary closure of affected areas of Madison Street Park located at 1218 E Madison St, Tampa, Florida, and to provide protective fencing during installation and teardown of scaffolding for a license fee of One Dollar ($1).

    Background

    Suffolk Construction Company, Inc. (Licensee) has contracted to paint the exterior of the Channel Club Apartments located at 1115 Twiggs St, Tampa, Florida which will require the installation of scaffolding to protect the public during this project.

    To install and teardown the erected scaffolding Licensee will encroach upon certain parts of Madison Street Park.

    The term of encroachment will be limited to those days that the scaffolding will be installed or torn down.

    Licensee acknowledges that it intends, by executing this Agreement, to assume all risks, whether known or unknown, which may arise from such activities.

    It is the desire of the parties to establish the terms and conditions under which the License and Hold Harmless Agreement will be implemented.

    City Council does hereby affirm that it would be beneficial to the residents of the City to enter into the attached Agreement.

    Background

    This resolution authorizes the Mayor and City Clerk to execute a contract with the U.S.

    Department of Veterans Affairs for the use of the Tampa Convention Center to host the National Veterans Golden Age Games from June 25 through July 2, 2026. The Games are an annual nationwide event for older veterans (generally age 55 and older) that promotes health, wellness, and camaraderie through adaptive sports and recreational competitions such as swimming, track and field, bowling, and golf.

    Background

    On February 16, 2023, City Council approved resolution 2023-165 for $42,376,104.21 as of the Comprehensive Infrastructure for Tampa’s Neighborhoods Project. The department modifying the agreement to be able to close out the contract for a cost saving of $4,298,138.86. Not all the funds were encumbered one time, instead were encumbered on an as need basis.

    This resolution reallocates funds in the amount of $2,302,292.66 from the Comprehensive Infrastructure for Tampa’s Neighborhoods Project to budget reserves within the Water Future Debt Capital Projects Fund.

    Resolution making certain changes in the budget of the City of Tampa for the fiscal year ending September 30, 2026; approving the transfer, reallocation, and/or appropriation of $18,588 within the General Fund Social Action and Arts Funding (SAAF) for payment of an invoice from New Tampa Players, Inc. relating to services provided during Fiscal Year 2024.

    Background

    In FY2024, New Tampa Players, Inc. entered into an agreement with the City of Tampa in the amount of $75,000 via Resolution 2024-154, passed and adopted by City Council on March 7, 2024. However, during FY2024, only three invoices totaling $56,412 were submitted to, and paid by the City, leaving a balance of $18,588 remaining on the agreement. These funds lapsed to fund balance at the end of the fiscal year. The last request for payment related to the FY2024 agreement was recently submitted to the City for payment.

    Resolution receiving and filing the City of Tampa Annual Comprehensive Financial Report (ACFR) for the Fiscal Year ending September 30, 2025.

    Background

    The attached Annual Comprehensive Financial Report (ACFR) provides an external audit for both the City of Tampa and the Tampa Historic Streetcar, Inc. (as a separate component unit of the City). Both audits were conducted by the City’s external auditor, Forvis Mazars, LLP of Tampa, and both received an “unmodified” or “clean” audit.

    FY2025 ACFR Highlights: *External Auditors’ Opinion: from Forvis Mazars, LLP Independent Auditor’s Report “We have audited the financial statements of the governmental activities, the business-type activities, the discretely presented component unit, each major fund, and the aggregate remaining fund information of the City of Tampa, Florida (the “City”) as of and for the fiscal year ended September 30, 2025, and the related notes to the financial statements, which collectively comprise the City’s basic financial statements, as listed in the table of contents.

    Resolution making certain changes in the budget of the City of Tampa for the fiscal year ending September 30, 2026; approving the transfer, reallocation, and/or appropriation of $585,000 within the Housing Program Fund for Affordable Housing activities.

    Background

    The City of Tampa entered into a Land Disposition Agreement for the redevelopment of the Rome Yard property. The project is being developed in multiple phases under ground leases with the City, with the exception of the townhome units, which are for-sale residential product.

    Under the terms of the Land Disposition Agreement, the City receives: • A one-time initial base rent payment of $2,500 per rental unit to be constructed in each leased phase, payable at lease commencement; and • Beginning in the second lease year and annually thereafter, 12.5% of the lessee’s net revenue related to operations of the project from the prior year, payable each April 15.

    The City recently received $585,000 associated with Phase 3A, known as Gallery at Rome Yards, representing the initial base rent payment required under the agreement. Future base rent payments are expected as additional phases of the project move forward, with Phase 4 anticipated to begin in the next few months. This financial resolution appropriates these funds within the Housing Program Fund for the Catholic Charities Contribution for Tampa Hope operations.

    Resolution approving the execution by the Mayor and attestation by the City Clerk of an Easement Agreement between the City of Tampa and Peoples Gas System, Inc., for the purpose of placing underground gas facilities at City-owned property located at 2507 East 26th Avenue, Tampa, Florida.

    Background

    Peoples Gas System, Inc. requested an easement from the City of Tampa for an easement at City-owned property located in the vicinity of 2507 East 26th Avenue to facilitate gas services.

    The Stormwater Engineering Division has no objection to granting this 30′ x 30′ (900 sf) easement for the installation and operation of a gas regulator station with a footprint of approximately 12′ x 8′. The property is operated by the Mobility Department as a wet retention pond.

    Resolution approving the execution by the Mayor and attestation by the City Clerk of a First Amendment to Contract for Sale and Purchase between the City of Tampa, as Seller, and RMC Tampa Commons, L.L.C., as Purchaser, to include language within the Quit Claim Deed releasing any interest in phosphate, minerals, metals or petroleum reservations in the City property located at 201 North Dale Mabry Highway, Tampa, Florida.

    Background
    1. The City agreed to sell an uneconomic remainder portion of City property, 1,073 square feet m.o.l., located at 201 North Dale Mabry Highway for development purposes. The City was notified of a request from the buyer’s title company to include language within the Quit Claim Deed releasing any interest the City may have in phosphate, minerals, metals or petroleum.

    The City and RUDG, LLC (“Developer”) entered into a Land Disposition Agreement, dated May 5, 2022, for the property generally known as Rome Yard, for the Developer to construct a development containing approximately 954 residential units, including affordable units.     The City and RUDG, LLC (“Developer”) entered into a Land Disposition Agreement, dated May 5, 2022, for the property generally known as Rome Yard, for the Developer to construct a development containing approximately 954 residential units, including affordable units. The property is being developed in phases. The City and Rome Yards Phase 4, LLC entered into a Ground Lease Agreement on September 1, 2024 for Phase 4 of the development. The parties desire to amend the lease to extend the outside completion date from December 31, 2027 to September 30, 2028, and to amend and add some provision in order to comply with construction financing documents. The parties are also agreeing to an exhibits for a Recognition Agreement and an Access and Garage Easement Agreement.

    (Part 1 of 2) (See item 17) Resolution approving a property exchange agreement by, between, and among the City of Tampa, Ulele, Inc., Florida Avenue Real Estate Holdings, LLC, and RHH 220 7th Ave LLC involving both the City’s former cable office building and a portion of the historic Zion Cemetery; providing, among other things, for the following exchanges of property interests for no monetary consideration: (1) the conveyance by the City of Tampa and RHH 220 7th Ave LLC of their respective interests in the City’s former cable office building and five (5) feet of an adjacent strip of land in the Tampa Heights Riverfront Community Redevelopment Area to Ulele, Inc. by separate deeds; (2) the conveyance by the City of Tampa and Ulele, Inc. of their respective interests in the remainder of the adjacent strip of land located west of the City’s former cable office building (less the five (5) feet adjacent to the former cable office building) in the Tampa Heights Riverfront Community Redevelopment Area to RHH 220 7th Ave LLC by separate deeds; and (3) the conveyance by Florida Avenue Real Estate Holdings, LLC, a closely related entity to Ulele, Inc., of a portion of the former historic Zion Cemetery to the City of Tampa or the City’s designee by special warranty deed; authorizing execution of said property exchange agreement by the Mayor.

    Background

    The City of Tampa holds potential property interests in two adjacent parcels within the Tampa Heights Riverfront Community Redevelopment Area: the former Cable Office Parcel and an Adjacent Strip. In March 2025, the City issued a Request for Proposals (RFP) for the possible disposition of these properties. Ulele, Inc. submitted a proposal for the Cable Office Parcel offering, through its related entity, Florida Avenue Real Estate Holdings, LLC, to convey property at 3721 Florida Avenue, land identified as part of the historic Zion Cemetery, in exchange for the City’s interest. This property includes a portion of Tampa’s first African- American cemetery, long abandoned and developed over time.

    The City determined that acquiring the Florida Avenue Property would support ongoing efforts to restore, preserve, and commemorate the historic Zion Cemetery. Additionally, both Ulele and RHH 220 7th Ave LLC responded to the RFP regarding the Adjacent Strip. The City agreed to divide this strip into two components: a larger Alley parcel adjoining property owned by RHH, and a Five-Foot Strip adjoining the Cable Office Parcel.

    Previous leasing and disposition actions involving the Cable Office Parcel were the subject of litigation initiated by Riverside Heights Development, LLC, a company related to RHH. To resolve any resulting property interests, Ulele, the City, and RHH agreed to exchange their respective interests in the Cable Office Parcel, the Five-Foot Strip, and the Alley.

    The City has determined that the Cable Office Parcel and Adjacent Strip are no longer needed for public or governmental purposes and has declared them surplus. All required statutory and policy procedures for disposition have been met in preparation for the proposed property exchange.

    (Part 2 of 2) (See item 16) Resolution approving an agreement regarding a portion of Zion Cemetery by and between the City of Tampa and the Zion Cemetery Preservation & Maintenance Society, Inc., allowing for the direct conveyance of title to a portion of Zion Cemetery to either the Zion Cemetery Preservation & Maintenance Society, Inc., or a third party designated by the Cemetery Society and the City by Florida Avenue Real Estate Holdings, LLC, pursuant to a separate property exchange agreement between the City, Florida Avenue Holdings, LLC, Ulele, Inc. and RHH 220 7th Ave., LLC, in lieu of the City; providing that said conveyance shall be subject to a declaration of covenants and restrictions in favor of the City to ensure that the property is owned, restored, enhanced, operated, maintained and preserved in perpetuity as part of the historic Zion Cemetery; authorizing execution of said agreement regarding a portion of Zion Cemetery by the Mayor.

    Background

    The Tampa City Council has approved a Property Exchange Agreement among the City of Tampa, Ulele, Inc., Florida Avenue Real Estate Holdings, LLC, and RHH 220 7th Ave LLC.

    As part of this agreement, Florida Avenue will convey a parcel of real property, referred to as the Florida Avenue Property, to the City or the Zion Cemetery Preservation & Maintenance Society, Inc., or another entity jointly designated by the City and the Cemetery Society. In exchange, the City will convey its interest in the Cable Office Parcel and the Alley to Ulele.

    The Florida Avenue Property was originally part of the historic Zion Cemetery, Tampa’s first African-American cemetery, which was later developed with housing and commercial structures. The Cemetery Society was established to support the ownership, restoration, enhancement, and preservation of the historic cemetery, including memorial markers or commemorative structures recognizing those buried there.

    The City and the Cemetery Society intend to enter into an Agreement Regarding a Portion of Zion Cemetery to facilitate the conveyance of the Florida Avenue Property to the Cemetery Society or a jointly designated entity. The conveyance is subject to a Declaration of Covenants and Restrictions in favor of the City to ensure that the property is preserved, enhanced, and maintained in perpetuity as part of the historic Zion Cemetery.

    Resolution of the city council of the city of Tampa, Florida, approving the Tampa Bay Estuary Program third amended and restated Interlocal Agreement; authorizing the payment of dues as a member of the Tampa Bay Estuary Program and policy board for fiscal years 2027 through and including 2031: authorizing execution by the mayor and attestation by the city clerk.

    Background

    The City of Tampa (“City”) is one of the founding members of the Tampa Bay Estuary Program (“TBEP”), including representation on its Management and Policy Boards. The TBEP currently has participants and members of various governmental agencies, including the City of Tampa. The TBEP is governed by an Interlocal Agreement between the members and partners, and the TBEP members and partners contribute funding annually towards the program. The Policy Board reviews and recommends updates to the Interlocal Agreement on a five-year basis, including fundings by dues. This Tampa Bay Estuary Program Third Amended and Restated Interlocal Agreement adds the City of Largo, Florida as a member and includes some adjustments to funding commitments of the members. The City benefits from its membership in the TBEP in the implementation of its stormwater and wastewater National Pollutant Discharge Program (“NPDES”) permits. The City agrees as a voting member of the TBEP to pay $70,913 for the Fiscal Year 2027 with an annual increase of 2.5% through Fiscal Year 2031. The City has determined that it is in the best interest of the citizens of the City to continue as a member and support the TBEP through Management and Policy Board participation, dues contribution, and approval of the Tampa Bay Estuary Program Third Amended and Restated Interlocal Agreement.     Staff is requesting Council to adopt the attached reimbursement resolution for the design/bid/build agreement of the Tampa Police Department (TPD) Howard Avenue Annex Building Project, Phase 2 in an amount not to exceed $27,174,500. Adoption of the reimbursement resolution preserves the City’s ability to issue tax-exempt debt. Without adopting the reimbursement resolution, any debt issued for this project would be issued as taxable debt at a higher interest rate.

    The Reimbursement Resolution allows the City to reimburse various costs and expenditures related to the acquisition, construction and equipping of the TPD Howard Avenue Annex Building Project, Phase 2. The City has paid for, and/or reasonably anticipates that it will pay for, such costs and expenditures from legally available funds within the General Fund and/or other governmental and capital funds of the City.
