    Resolution approving, consenting to and confirming the re-appointment by the Mayor of Sul Hemani as a member of the Tampa Housing Authority for a four year term commencing retroactively on March 4, 2025, and ending March 3, 2029; Providing an effective date.

    Background

    On March 4, 2021, the City Council of the City of Tampa approved Resolution No. 2021-173, approving, consenting to and confirming the appointment by the Mayor of Sul Hemani as a member of the Tampa Housing Authority and the Mayor has re-appointed and hereby submits to City Council for approval, the name of Sul Hemani as a member of the Tampa Housing Authority for a four (4) year term commencing retroactively on March 4, 2025, and ending March 3, 2029.

    Resolution setting administrative costs for School Speed Zone Camera violation scheduled hearings at fifty dollars ($50.00) upon the issuance of a Final Administrative Order after a violation is upheld after a scheduled hearing or upon the cancellation of a scheduled hearing due to payment, pursuant to Section 14-56 of the Tampa City Code.

    Background

    On January 11, 2024, Tampa City Council adopted City of Tampa (“City”) Ordinance No. 2024-3, which added Section 14-56 to the Tampa City Code establishing a school speed zone camera enforcement program as authorized under and in accordance with the requirements of Chapter 2023-174, Laws of Florida. Section 14-56 of the Tampa City Code, among other things, requires that the City provide written notice to persons alleged in violation of school speed zone limits as captured by a camera speed detection system, and allow those persons to request or petition for a hearing to contest the alleged violation before a local hearing officer in accordance with the procedures and requirements contained in Section 316.1896, Florida Statutes. Section 14-56 of the Tampa City Code also requires that the City comply with Section 316.1896, Florida Statutes, in connection with the assessment of fines and costs for violations of school speed zone limits as captured by a camera speed detection system authorized by state law. Section 316.1896, Florida Statutes, allows a person who has petitioned for a hearing on a notice issued for violation of a school speed zone limit as captured by a camera speed detection system to cancel his or her appearance before the local hearing officer by paying the required penalty authorized in that statute and Section 14-56 of the Tampa City Code, plus administrative costs in the amount of $50.00 established in Section 316.0083(5)(c), Florida Statutes, before the start of the hearing.

    Pursuant to Section 14-56 of the Tampa City Code and Sections 316.1896 and 316.0083(5)(e), Florida Statutes, Tampa City Council also authorizes and requires the payment of the City’s administrative costs in the amount of $50.00 when an appearance before a local hearing officer results in a school speed zone camera violation issued by the City being upheld by a local hearing officer as more particularly described in this Resolution.

    Resolution approving an Agreement between the City of Tampa and Teledyne Flir Defense, Inc. fka Teledyne Flir for the standardization purchase of an Extended Warranty for Star Safire 380HDc Imagine Flir Defense System in the estimated amount of $85,749 for use by the Tampa Police Department.

    Background

    The Tampa Police Department has standardized Star Safire 380HDc Imaging FLIR Defense System from Teledyne FLIR Defense, Inc. Standardization to this equipment is needed because these are very complex and complicated systems that contain a daytime camera, a long range spotter scope, a IR camera and two IR laser illuminaters, ensures interoperability because of familiarity among staff, and maintenance efficiency. It is recommended that the City purchase the Extended Warranty for Star Safire 380HDc Imaging FLIR Defense System.

    There was no EBO Participation as this purchase is being made under a standardization.

    (Part 1 of 2)(See Item 5) Resolution approving an award letter incorporating Grant Agreement Articles and an Obligating Document pursuant to the fiscal year 2024 Fire Prevention and Safety Grant (No. EMW-2024-FP-00700) in the amount of $229,821.90 between the City of Tampa and the United States Department of Homeland Security; authorizing execution by the Mayor and attestation by the city clerk; and providing an effective date.

    Background

    This grant agreement authorizes payment from the United States Department of Homeland Security, in the amount of $229,821.90 for the purchase of a fire safety trailer that includes a fire safety simulator, kitchen props (over fire, toaster, fire, and pot on stove), children’s bedroom, heated door with smoke, and age-appropriate fire extinguisher simulation. This resolution approves a cost-reimbursement contract and the acceptance of a grant award in the amount of $229,821.90 from the United States Department of Homeland Security. Funds will be appropriated for Tampa Fire Rescue within the Fire Grants Fund. The required city match is $11,491.10. The fire safety trailer will be used to lead a Community Risk Reduction Hands-on Student Fire Education Campaign. The objective of the project is to reach 5,000 students with this hands-on program during the grant period (two-year period) and for at least 50% of students to demonstrate increased knowledge.

    (Part 2 of 2)(See Item 4) Resolution making certain changes in the budget of the City of Tampa for the fiscal year ending September 30, 2026; approving the transfer, reallocation, and/or appropriation of $229,821.90 within the Fire Grants Fund for use by Tampa Fire Rescue for the Fiscal Year 2024 Fire Prevention & Safety Grant.

    Background

    Tampa Fire Rescue received a federal grant from the United States Department of Homeland Security, in the amount of $229,821.90 with a required match of $11,491.10, for the purchase of a fire safety trailer. The fire safety trailer will be used to lead a Community Risk Reduction Hands-on Student Fire Education Campaign. The City match will come from Fleet CIT Program #6.

  6. File No. PS25-18181

    Resolution amending Resolution No. 2025-299, passed and adopted by the City Council of the City of Tampa on March 27, 2025 to correct an error in the vendor’s name in the title, and in the third and fifth whereas clauses, and in sections 1 and 2 of said resolution by deleting Thermo Fisher Scientific Inc. and inserting Fisher Scientific Company, LLC.

    Background

    On March 27, 2025, Council approved an award between the City of Tampa and Thermo Fisher Scientific Inc. This is a correction to a Scrivener’s Error in the original award. This Scrivener’s Error has been created to change the vendor name from Thermo Fisher Scientific Inc. to Fisher Scientific Company, LLC. Except as expressly modified by this City Council resolution, all other terms and conditions of the purchase remain unchanged and in full force and effect.

    There was no EBO Participation as the original purchase was made under a piggy-back agreement.

    Resolution approving the disposition and donation of one (1) canine (K-9) “Shadd” of the Tampa Police Department K-9 unit to retired MPO Bradley Simmonds; execution of the Hold Harmless Agreement by the Mayor of the City of Tampa and attestation by the City Clerk.

    Background

    The German Shepherd K-9 known as “Shadd” with I.D. # PC 121062 will be removed from the Tampa Police K-9 Unit due to retirement. Chief Lee Bercaw and the officers of the K-9 Unit desire to donate “Shadd” to retired MPO Bradley Simmonds for humane purposes. Such disposition would be in the best interest of all parties involved.

    Resolution of the city of Tampa, Florida, approving a First Amendment to Software License and Maintenance Agreement between the City of Tampa and RecTrac, LLC, d/b/a Vermont Systems, Inc., to include annual Interface Fees for the Processing System used by the Parks and Recreation Department in the estimated amount of $31,050.

    Background

    Pursuant to Resolution 2009-1208, passed and adopted on December 3, 2009, the City went into agreement for the provision of Parks and Recreation Automated Tracking, Reservation and Payment System. Pursuant to Resolution 2024-1130 passed and adopted on December 19, 2024, the City added an addendum to include hosting through RecTrac, LLC dba Vermont Systems. Parks and Recreation desires to further amend the agreement to include annual interface fees. When the Parks and Recreation move to a Payment Card Industry complaint credit card processor, Card Connect, RecTrac, LLC dba Vermont Systems started charging a maintenance fee to support the interface between Card Connect credit card gateway and the RecTrac application.

    Resolution approving the Renewal of an award between the City of Tampa and Nelson’s Tree Farm & Nursery, Inc. with a Consumer Price Index (CPI) price escalation of 2.7% for the furnishing of Mulch and-or Shell Purchased, Delivered and-or Installed (Sheltered Market Solicitation) in the estimated amount of $359,450 for use by the Parks and Recreation Department.

    Background

    It is recommended that the City renew its existing award with Nelson’s Tree Farm and Nursery, Inc. for the provision of Mulch And-Or Shell Purchased, Delivered And-Or Installed (Sheltered Market Solicitation) for use by the Parks and Recreation Department for an additional one-year term. The existing award was made January 11, 2024. This award is in its first renewal period.

    Nelson’s Tree Farm and Nursery, Inc. provides excellent service, quality of product and performance. The Parks and Recreation Department has reviewed the prices and feels that it is in the best interest of the City to renew the award for an additional one-year period.

    Nelson’s Tree Farm and Nursery, Inc. has agreed to renew Mulch And-Or Shell Purchased, Delivered And-Or Installed (Sheltered Market Solicitation) with a Consumer Price Index (CPI) price escalation of 2.7%; which is allowed per the bid.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, it was determined that the EBO Sheltered Market Solicitation provision applied in the bid specifications to the eligible U-WMBE & SLBE firms. The awardee, Nelson’s Tree Farm and Nursery, Inc, is a certified Small Local Business Enterprise (SLBE).

The Wastewater Department does not have in-house asphalt restoration capabilities and relies on this contract for restoration of asphalt pavement after City forces have completed sewer repairs.

    Resolution of the City Council of the City of Tampa, Florida, approving a map or survey of a segment of North 24th street, as more particularly described herein, for the purpose of filing in the records of the Clerk of the Circuit Court of Hillsborough County, Florida, as prima facie evidence of ownership and dedication of that segment of North 24th street as public right-of-way pursuant to section 95.361, Florida statutes; authorizing the execution of a certificate on the map or survey by the Mayor and the City Clerk as required by section 95.361, Florida statutes; providing for the filing of the map or survey with the Clerk of the Circuit Court for Hillsborough County, Florida.

    Background

    A portion of North 24th Street lying between East Diana Street and East Sligh Avenue, as more particularly described in physical copy of the map or survey, a digital copy of which is attached hereto for reference, has never been formally dedicated as public right-of-way; and the entity that constructed North 24th Street is unknown; and the City of Tampa (“City”) has continuously and uninterruptedly maintained and/or repaired this segment or portion of North 24th Street for a period of more than seven (7) years; and the City maintains records demonstrating maintenance activities dating back to 2011, including eight work orders for sign repair, traffic signal installation, and erosion maintenance; and section 95.361, Florida Statutes, provides that a road that has been constructed by the Department of Transportation, a county, or a municipality which has been maintained or repaired continuously and uninterruptedly for four (4) years by the county, municipality, or Department of Transportation (jointly or severally) shall be deemed to be dedicated to the public to the extent of the width that has actually been maintained for the prescribed period; and section 95.361, Florida Statutes, provides that a road that has been constructed by a nongovernmental entity which has been regularly maintained or repaired for the immediate past seven (7) years by a county, municipality, or Department of Transportation (jointly or severally) shall be deemed to be dedicated to the public to the extent of the width that has actually been maintained for the prescribed period; and section 95.361, Florida Statutes, also provides that the filing of a map or survey with the Clerk of the Circuit Court in which the road is located with a certificate executed by the Mayor and clerk of the municipality will constitute prima facie evidence that the title to the road has vested in the municipality; and it appears that the segment or portion of North 24th Street shown on the attached map or survey meets the requirements for the City to claim title pursuant to section 95.361, Florida Statutes; and it is in the best interest of the citizens of the City to follow the procedure established in section 95.361, Florida Statutes, and file the attached map or survey in the Public Records of Hillsborough County, Florida.

    Resolution approving the renewal of awards between the City of Tampa and Plum Creek Environmental for Divisions I, II and III and Iron Container, LLC for Division IV, without price escalations, for the purchase of Compactors and Roll-Off Containers in the estimated amount of $2,198,540 for use by the Department of Solid Waste & Environmental Program Management.

    Background

    It is recommended that the City renew its existing award with Plum Creek Environmental (Div.

    I, II, III) and Iron Container (Div. IV) for the provision of Compactors and Roll-Off Containers for use by the Department of Solid Waste and Environmental Program Management for an additional one-year term. The existing award was made in February 2023. This award is in its second renewal term.

    Plum Creek Environmental (Div. I, II, and III) and Iron Container (Div. IV) provide excellent service, quality of product and performance. The Department of Solid Waste and Environmental Program Management feels that it is in the best interest of the City to renew the awards for an additional one-year period. Plum Creek Environmental (Div. I, II, and III) and Iron Container (Div. IV) have both agreed to renew the Compactors and Roll-Off Containers contract without a price escalation which is allowed per the bid.

    Pursuant to the review by the Equal Business Opportunity (EBO) Division, this one year renewal contract is in compliance.

    Resolution approving contract Change Order 1 adding $135,455.97 to the contract between the City of Tampa and Phinazee Construction & Consulting Services, Inc. for Contract 24-C-00016, Construction of Herman Massey Park Rehabilitation.

Equal Business Opportunity (EBO) Statement: Phinazee Construction and Consulting Services, Inc., the prime contractor, is a city-certified Small Local Business Enterprise (SLBE) and Minority Business Enterprise (MBE/BBE) and is committed to utilizing two (2) SLBE city- certified firms for subcontracting to augment TBD% of the change order 1 per Form DMI-20.

    Resolution to approve a Conflict-of-Interest Waiver between the City of Tampa, Urban Tampa DB Hotel Owner, LLC and Terracon Consultants, Inc.; authorizing the Mayor to execute the agreement.

    Background

    The property at 405 E. Kennedy Boulevard is under a Brownfield Site Remediation Agreement between the City of Tampa and Urban Tampa DB Hotel Owner, LLC for environmental cleanup and conditional closure.     The FY26 millage assessed by Hillsborough County and the Tampa Port Authority is adopted after the City of Tampa’s FY2026 budget adoption and therefore changes must be made by separate resolution. Hillsborough County reduced their General Revenue millage rate by .1418 mills and the Tampa Port Authority reduced their millage rate by .0033 mills compared to what the City adopted resulting in a total reduction of $574,757 in overall CRA TIF Revenue.

    Background

    The CRA Board approved the appropriation of interest and other income earned to the respective CRA Funds to make these funds available for future expenditures. In order to make these funds available in a timely manner, interest will be recorded on a quarterly basis.

    Through the third quarter of FY2025 interest income earned was $4,402,784 and other income earned was $66,056 for a total of $4,468,840 to be appropriated in FY2025. Other income consists of sale proceeds of equipment used for the East Tampa CRA Summer Youth Program, reprogrammed to the East Tampa Neighborhood Infrastructure Project.

    Pursuant to Section 166.241(8)(a), under certain circumstances a local government within 60 days following the end of the fiscal year may amend a budget for that year.

    Background

    In accordance with Chapter 1997-351, Laws of Florida, the Hillsborough County City-County Planning Commission (“Planning Commission”) is charged with reviewing amendments to the land development code and making recommendations as to the consistency of said amendments with the City of Tampa Comprehensive Plan and as a result of the passage of Chapter 2025-190, Laws of Florida, the City is preempted from adopting “more restrictive or burdensome” land development regulations as of August 1, 2024, rendering such regulations null and void ab initio.

    On September 5, 2024, the City Council of the City of Tampa (“City Council”) adopted Ordinance 2024-89, which included amendments to Section 27-178 of the City of Tampa Code of Ordinances to require additional safety and security measures in Ybor City parking lots and due to assertions from the community that the revised Ybor City parking regulations are more restrictive or burdensome, at its September 25, 2025, workshop City Council considered revisions to the Ybor Parking regulations that would maintain minimum standards for parking lots in Ybor City which are not more restrictive or burdensome than those that existed on August 1, 2024.

    The City Council has reviewed and desires intends to transmit said revisions to Section 27- 178 to the Planning Commission for its review in accordance with Chapter 97-351, Laws of Florida, as amended.

    American Grinding Company, LLC dba American Sidewalk Management provides satisfactory service, quality of product and performance. The Mobility Department has reviewed the prices and feels that it is in the best interest of the City to renew the award for an additional one-year period.     Moreno Industrial Services Inc. provides satisfactory service, quality of product and performance.     Background

    Site developers Broadway Holdings LLC and their legal representative Gramling Environmental Law, P.A are in the process of submitting a complete application to the City of Tampa for a brownfield area designation of approximately 12.33 acres in East Tampa. City Staff has reviewed the application and recommends designation of the area identified as Broadway Holdings area as a brownfield. Details of the proposed brownfield area designation are outlined in the attached Staff Report on Broadway Holdings Dated September 2025.

    1. Contract Title: 23-C-00021 South Howard Flood Relief Project a. Address of Project: Parkland Estates, New Suburb Beautiful, Historic Hyde Park and Bayshore Gardens b. Number of bidders/submitters: N/A c. Names of bidders/submitters: N/A d. Dollar amount: $4,132,878.38 e. Why the awardee was selected: Selected pursuant to FS 287.055 CCNA (Consultants’ Competitive Negotiation Act).
    2. Contractor/Firm: Kimmins Contracting Corp.
    3. Business Case: Project provides for the design and construction of approximately 7,000 linear feet of stormwater conveyance, 11,800 linear feet of various sized water mains to be replaced/upgraded along South Howard Avenue within the watershed to alleviate flooding.
    4. Equal Business Opportunity (EBO) Statement: The EBO subcontract goal for GMP-01 has been calculated and subsequently confirmed by the Goal Set Review Committee at a 24% SLBE goal. The Design/Build contractor has acknowledged the narrowly tailored EBO subcontract goal.
    5. Sustainability and Resiliency: Project will include the development of practical green- solutions to improve stormwater quality and provide sustainable concepts that can be incorporated into the project both as part of the proposed stormwater infrastructure, within the project area that align with the goals of the CITY’s “Green Tampa” Initiatives and the individual focus areas that are part of that program. This shall include Best Management Practices (BMP) and two alternate options for green infrastructure to be used, where appropriate, throughout the project. Wetland and surface water seasonal highwater levels will be identified along the project corridors.
    6. Community Engagement: Project will include an Initiation/Listening phase that will occur when the project is presented to the Stakeholders. Stakeholder interactions will present the project context with goals and benefits and provide opportunities to listen to and document stakeholder input regarding their ideas, concerns, and priorities. This phase will also provide stakeholders with direct responses and contribute to the development of an FAQ document, with the assistance of other project team members, addressing the more common questions and/or concerns.
    7. Project: a. Contract delivery method: This is a Design-Build project. A full-time City of Tampa Construction Inspector will be on-site during the project to ensure quality of construction.

    Project scope generally includes data collection, public outreach, engineering design, permitting assistance, and negotiation of a guaranteed maximum price (GMP) for construction of a new major stormwater trunk line that runs the length of the project corridor. The project includes full replacement of the improvements within the rights-of-way of S. Howard Avenue and replacement of impacted surface improvements in all the other rights-of-way along the main corridor.

    This Guaranteed Maximum Price (GMP 1) provides for early work efforts to include, but not limited to: maintenance of traffic (MOT), site preparation, installation of water mains, and roadway reconstruction.

    b. Placemaking: N/A c. Time, Quality Assurance, Cost Monitoring (Budget) • 150 consecutive calendar days.

    • The e-Builder project management software system will be utilized to optimize the monitoring of schedules and costs. This software was recently purchased by the City of Tampa and is a premier system for construction project management.

Resolution making certain changes in the budget of the City of Tampa for the fiscal year ending September 30, 2026; approving the transfer, reallocation, and/or appropriation of $3,178,263 for the South Howard Flood Relief & Streetscape Project for use by Mobility Department within the Water Renewal and Replacement Fund; providing an effective date.E., Deputy Administrator of Infrastructure, transmitting additional information for said agenda item.

    Background

    This project provides for the design and construction of approximately 7,000 linear feet of stormwater conveyance, 11,800 linear feet of various sized water mains to be replaced/upgraded, and 3,200 linear feet of gravity sewer to be relocated along South Howard Avenue within the watershed to alleviate flooding. The total agreement is for $4,132,878.38 of which $3,178,263 is for Water related work.

    This resolution reallocates $3,178,263 from the Water Distribution Program Project to the South Howard Flood Relief & Streetscape Project for use by the Mobility Department within the Water Renewal and Replacement Fund.
